Send the original by certified mail, and pay for a \u201creturn receipt\u201d so you have proof that the collector received it. Hiring a lawyer may cost you but it will <a href=\"https:\/\/mcintirelaw.com\/west-virginia-creditor-harassment\/\"><u>stop the harassment<\/u><\/a> if your creditors and bill collectors continue to do so even if you already wrote a letter request.<\/p>\n<p>Under the <a href=\"https:\/\/www.ftc.gov\/enforcement\/rules\/rulemaking-regulatory-reform-proceedings\/fair-debt-collection-practices-act-text\"><u>Fair Debt Collections Practices Act<\/u><\/a>, it is illegal for debt collectors to do the following:<\/p>\n<ul>\n<li>Contact your relatives, employer or neighbors about your debt (they may only get in touch with them to get contact information, but they may not mention the debt or mention that they are from a debt collection agency)<\/li>\n<li>Call you late at night or at unreasonable hours (they should not call before 8 a.m. or after 9 p.m. unless otherwise agreed that they can call beyond these hours)<\/li>\n<li>Call you at work when there was a verbal or written advice not to call at the place of work<\/li>\n<li>Call you repeatedly to annoy, abuse, or harass you or any other person who took the call<\/li>\n<li>Engage in false, deceptive, or misleading conduct<\/li>\n<li>Calling you without telling who they are]Use obscene or profane language, including derogatory or insulting remarks<\/li>\n<li>Threaten bodily harm, arrest or loss of child custody or welfare benefits<\/li>\n<li>Publish your name in a list of people who refuse to pay their debts<\/li>\n<li>Use any communication, language or symbols on envelopes or postcards that indicate that the sender is from a collection agency<\/li>\n<li>Threaten to sue you unless they truly intend to take you to court.<\/li>\n<\/ul>\n<p>If the collection agency is violating any of these laws, you may file a legal case against them and demand restitution for damages, your lawyer\u2019s fees, plus an additional $1,000.00.<\/p>\n<h3 class=\"fusion-responsive-typography-calculated\" style=\"--fontsize: 22; line-height: 1.67; --minfontsize: 22;\" data-fontsize=\"22\" data-lineheight=\"36.74px\"><span class=\"ez-toc-section\" id=\"Tip_no_4_File_for_bankruptcy\"><\/span>Tip no. 4: File for bankruptcy.<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The most drastic measure to put an end to the harassment of collection agencies is to petition for bankruptcy. Usually, the bankruptcy court does not grant approval to collection agencies demanding payment for unsecured debts like credit card debts, utility bills, and medical debt.
